TERMS OF SERVICE

Welcome to FitCost Sync. These Terms of Service ("Terms") govern your access to and use of the FitCost Sync mobile application, website (fitcostsync.com), and related services (collectively, the "Service"), operated by FitCost Sync, LLC ("Company," "we," "us," or "our"). By creating an account or utilizing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

FitCost Sync provides an AI-driven computational platform that estimates macronutrient requirements, generates meal options via conversational natural language processing, forecasts commodity costs, and interfaces with third-party logistics providers (such as Instacart) for grocery procurement logistics.

2. Nutritional & Medical Disclaimer (Critical Notice)

• Informational Use Only: FitCost Sync is a technological computational tool. We are not a medical organization, registered dietitian, or certified health professional. The automated calculations, chatbot outputs, and nutritional profiles generated by the Service are algorithmic estimates and do not constitute medical advice or nutritional therapy.

• Assumption of Risk: You acknowledge that nutritional requirements vary fundamentally by individual health status, metabolic factors, and underlying conditions. You must consult a licensed medical professional prior to implementing any dietary alterations, particularly if you have metabolic disorders, allergies, or are pregnant. The Company assumes no liability for adverse health outcomes resulting from reliance on algorithmically generated plans.

3. Subscriptions, Fees, and Apple App Store Billing

• Subscription Tier: Access to premium functionality requires a recurring subscription fee of $4.99 per month.

• In-App Purchases (IAP): All financial transactions, billing, and subscription management are processed securely through the Apple App Store framework.

• Auto-Renewal: Your subscription automatically renews every month unless auto-renew is disabled in your Apple ID Account Settings at least twenty-four (24) hours prior to the conclusion of the active billing cycle.

• Refunds: All refund requests are handled exclusively by Apple Inc. governing terms and conditions; the Company cannot directly authorize or issue credits.

4. Third-Party Supply Chain Limitations

• Pricing & Inventory Variance: FitCost Sync utilizes data mapping to estimate grocery expenditures. Actual local retail store prices, delivery service markups, and real-time product inventory fluctuate constantly. The Company does not guarantee that retail checkout fees will exactly match inside-app forecasting.

• Fulfillment Failure: Physical grocery assembly and delivery are executed by independent logistics networks (e.g., Instacart). We hold no responsibility or liability for incorrect orders, food safety handling, delivery failures, or damage to goods incurred during external transit.

5. Data Privacy & Integrity

Your privacy is fundamentally important to us. Our processing of platform data, tracking markers, and Apple HealthKit permissions is governed by our Privacy Policy. We enforce strict technical protocols to ensure individual health data is completely encrypted and never sold to marketing data aggregators.

6. Limitation of Liability

To the maximum extent permitted by applicable law, FitCost Sync, LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or health complications resulting from your use of or inability to use the Service.

7. Governing Law

These Terms and any operational disputes arising out of the Service shall be governed by, construed, and enforced exclusively in accordance with the laws of the State of Florida, without regard to its conflict of law rules.

8. Termination of Accounts

We reserve the right, without notice and at our sole discretion, to terminate your account or restrict your access to the platform for violations of these Terms, operational data manipulation, or fraudulent billing activity. You may delete your account and request data purging at any time via the user dashboard interface.

• Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's storage, apple health app (healthkit), and other features. If you wish to change our access or permissions, you may do so in your device's settings.
• Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server). If you are using our application(s), we may also collect information about the phone network associated with your mobile device, your mobile device’s operating system or platform, the type of mobile device you use, your mobile device’s unique device ID, and information about the features of our application(s) you accessed.
• Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.
